Tree Preservation Orders are made under the Town and Country Planning Act 1990 and the Town and Country Planning Tree Preservation (England) Regulations 2012 by local planning authorities in England.
What is the Purpose?
An order can be put in place to protect specific trees, one tree or a whole defined area of trees, in gardens or woodlands. The order prohibits: the wilful destruction or damage as well as the cutting down, uprooting, lopping or topping of trees without the local planning authority’s written permission.
If consent is given it can be subject to conditions and these must be adhered to.
Your Responsibilities as a Tree Owner

What if I want to Work on a Protected Tree?

You will need written permission from your local council before you can carry out any type of work whatsoever, subject to exemptions

They will often check if you’ve been in contact with a qualified tree surgeon to clarify required works and if permission is required. (The tree surgeon would help you with this)
What Happens if I don’t Follow the [T.P.O.]Guidelines?

You could be fined up to £25,000, if convicted in the magistrates court
